1. Introduction

Annique Rooibos ("Annique", "we", "us", or "our") respects your privacy and is committed to protecting your personal information. We only use your personal information to process your orders, manage your account, communicate and improve our services. We never sell your information.

This Privacy Policy explains how we collect, use, share, and safeguard personal information when you visit our website, place an order, or interact with us, in accordance with the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) ("POPIA") and other applicable South African law.

3. Personal information we collect

We collect personal information that you provide to us directly, that we collect automatically when you use our website, and that we receive from third parties. This may include:

  • Identity and contact information: name, surname, ID number (where required), email address, telephone number, delivery and billing address.
  • Account information: username, password, account preferences, Consultant or customer ID.
  • Transaction information: order history, products purchased, payment method, billing details (we do not store full card numbers — see section 8).
  • Communications: the content of messages you send us, customer service queries, feedback, and reviews.
  • Marketing preferences: your subscriptions, opt-ins and opt-outs.
  • Technical and usage information: IP address, device type, operating system, browser type, pages visited, referring URL, time on site, and other analytics data.

4. How we use your personal information

We process your personal information for the following purposes:

  • To process and fulfil your orders, including payment, packaging, delivery, and returns.
  • To create and manage your account.
  • To communicate with you about your orders, account, or queries.
  • To send you marketing communications where you have consented or where permitted by law.
  • To improve our website, products, and services through analytics and customer research.
  • To comply with our legal obligations, including tax, accounting, and consumer protection law.
  • To detect, prevent, and respond to fraud, abuse, or security incidents.
  • To exercise or defend our legal rights.

5. Lawful basis for processing

We process your personal information only where we have a lawful basis under POPIA, including:

  • Consent: where you have given us specific, informed, and voluntary consent (for example, marketing emails).
  • Contract: where processing is necessary to perform a contract with you, such as fulfilling an order.
  • Legal obligation: where processing is required by law.
  • Legitimate interests: where processing is necessary for our legitimate interests and does not unduly prejudice your rights.

You may withdraw consent at any time by removing consent on your Profile on the Store. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

6. Sharing your personal information

We do not sell your personal information. We may share it with:

  • Service providers (operators) who process information on our behalf — including payment gateways, courier and logistics providers, IT and hosting providers, email and SMS providers, and analytics providers. These operators are bound by contract to process your information only on our instructions and to keep it secure.
  • Independent Annique Rooibos Consultants. By placing an order through our website, or where you are referred by an Independent Annique Rooibos Consultant, you consent to Annique Rooibos sharing your personal information with that Consultant. Such information may include your name, contact details, delivery information, and order history. You further consent to the processing of your personal information by Annique Rooibos and its Consultants for all purposes reasonably related to the fulfilment of your order, the servicing of your customer relationship, after ‑ sales support, and related business operations, in accordance with POPIA and this Privacy Policy. Consultants act under their Consultant Agreement with Annique Rooibos and must process your personal information only in line with their contractual obligations and POPIA. Annique Rooibos remains the responsible party under POPIA for the processing of your personal information, including where it is shared with Consultants.
  • Regulators, law enforcement, and courts where we are legally obliged to disclose information, or to protect our rights or the safety of others.
  • Successors in the event of a merger, acquisition, restructuring, or sale of business assets.

7. Cookies and tracking technologies

Our website uses cookies and similar technologies to operate the site, remember your preferences, analyse usage, and (where you have consented) deliver personalised marketing. You can control cookies through your browser settings or any cookie banner we present. Disabling cookies may affect some functionality of the site.

8. Payment information

Payment card details are processed directly by our PCI-DSS compliant payment gateway. We do not store your full card number, CVV, or expiry on our servers.

9. Cross-border transfers

Some of our service providers may process personal information outside South Africa. Where we transfer personal information across borders, we take steps to ensure that the recipient is bound by laws, binding corporate rules, or contractual terms providing an adequate level of protection consistent with POPIA section 72. This may include, for example, our payment gateway, cloud hosting, and email or SMS delivery providers where these are located outside South Africa.

10. Retention

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, including any legal, accounting, or reporting obligations. When personal information is no longer required, we will securely delete or de-identify it.

11. Security

We implement appropriate technical and organisational measures to protect personal information against unauthorised access, loss, alteration, or disclosure, including access controls, encryption in transit, secure hosting, and staff training. No system is entirely secure; if we become aware of a security compromise affecting your personal information we will notify you and the Information Regulator as required by POPIA section 22.

12. Your rights

Subject to POPIA, you have the right to:

  • Be notified that your personal information is being collected, or has been accessed by an unauthorised person.
  • Request access to the personal information we hold about you.
  • Request correction or deletion of personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully.
  • Object to the processing of your personal information, including for direct marketing.
  • Withdraw consent at any time where processing is based on consent.
  • Submit a complaint to the Information Regulator (see section 15).

13. Children

Our website is not directed at children under 18. We do not knowingly collect personal information from children without the consent of a competent person. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

We may update this Privacy Policy from time to time. The latest version will always be available on our website, and the "last updated" date below will reflect when changes were made. Material changes will be communicated to you where required.
